Is landlord responsible for black mold in apartment?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold growing in the corner of our master bedroom closet. We've lived here for 2 years and just noticed it when we were doing a deep clean, and I think it's been there for a while, maybe since last winter's humidity. Our apartment is in Jumeirah Village Circle and the dehumidifier runs almost constantly.
Is the landlord responsible for fixing this and the potential health issues, or is this considered our problem because we should have caught it earlier?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for maintaining the property's structural integrity and ensuring it is habitable. This includes addressing issues like water infiltration and resultant mold growth that are due to inherent building defects, such as leaking pipes, faulty waterproofing, or poor ventilation systems. The persistent humidity in Dubai, exacerbated by year-round AC use leading to condensation, is a known catalyst for mold, and the responsibility to rectify the underlying moisture source often falls on the property owner.
However, tenant responsibilities are also outlined. You are obligated to report any defects promptly upon discovery. While you've lived there for two years, the argument of whether you "should have caught it earlier" could be contested. The landlord may claim negligence if the mold resulted from a tenant-induced moisture issue, but a constantly running dehumidifier in JVC strongly suggests an ambient humidity problem indicative of a building-related issue. For a definitive resolution, a professional inspection is critical. We must identify the exact moisture source—whether it's an internal leak, condensation, or external seepage—to determine liability. The health implications for your children underscore the urgency. Our certified inspectors at Saniservice conduct comprehensive moisture mapping and air quality testing to provide an authoritative report that can be used to formally liaise with your landlord or Dubai Municipality if necessary. Do not attempt to remediate this yourself, as disturbing the mold can exacerbate the health risks.
