Is landlord responsible for black mold in Dubai apartment?« Back to Previous Page

My kids have been coughing and I suspect it's because of the black mold I just found behind our wardrobe in the master bedroom. We've lived in this Jumeirah Village Triangle apartment for 2 years and just noticed it when we moved the furniture to clean. With all the humidity lately, it’s gotten much worse. Is the landlord responsible for fixing this and the potential health issues, or is this considered our problem as tenants?

Based on UAE Civil Code and Law No. 26 of 2007, the landlord is typically responsible for maintaining the structural integrity of the property. This includes addressing issues like black mold, which is often a symptom of a building envelope defect, such as water infiltration from leaking pipes, faulty external sealing, or poor insulation—all of which are the landlord's obligation to repair.

However, the specific responsibility can depend on the cause. In Dubai's humid climate, with year-round AC use, condensation is a major contributor to mold growth. If the mold is a direct result of tenant behavior, such as a failure to use the AC properly to control humidity, inadequate ventilation, or blocking AC vents with furniture, the tenant may be liable for the remediation costs. The discovery behind a wardrobe suggests a potential combination of poor air circulation and a pre-existing dampness issue.

Given that your children are exhibiting health symptoms, this is a serious case that requires immediate professional assessment. Do not attempt to remove it yourself, as improper handling can aerosolize spores and exacerbate the health risks and contamination. A certified mold inspector can conduct air and surface sampling to identify the species and concentration, and more importantly, diagnose the root cause (e.g., condensation vs. leak). This professional report is crucial evidence for formally notifying your landlord of their responsibility.
