Is landlord responsible for black mold in Dubai apartment?« Back to Previous Page

We've lived in our Jumeirah Village Triangle apartment for two years, but just noticed a bunch of black mold spreading along the baseboards in the master bedroom closet, which is on an exterior wall. It seems to have gotten much worse since the heavy humidity a few weeks ago. Are we responsible for cleaning this and fixing the problem, or is this something the landlord has to handle?

Based on UAE rental law, specifically Law No. (26) of 2007, the landlord is generally responsible for the maintenance of the property's main structure, including issues with the building envelope that lead to water intrusion or excessive condensation. The presence of black mold along an exterior wall baseboard, exacerbated by recent high humidity, strongly suggests an underlying structural or building integrity issue, such as a hidden water leak from a pipe, faulty waterproofing, or insufficient insulation causing persistent condensation. These are not considered normal wear and tear.
Your responsibility as a tenant would typically be limited to general upkeep and reporting the issue in a timely manner. You must formally notify your landlord or property management company in writing about the mold, as this is a health and safety concern. Do not attempt to clean significant mold growth yourself, as improper remediation can aerosolize spores and worsen contamination. Given Dubai's climate, with high ambient humidity and year-round AC use, condensation within wall cavities is a common failure point that requires professional diagnosis. We strongly recommend a certified mold inspection to identify the precise moisture source and extent of contamination. This objective report is crucial for determining liability and the required scope of remedial work.
