Is landlord responsible for black mold in Dubai apartment?« Back to Previous Page

We've lived in our Discovery Gardens apartment for 2 years and just noticed a huge patch of black mold in the corner of our master bedroom closet, behind some storage boxes. It must have been growing for months, and it’s on both the wall and the carpet. With all the humidity lately, it’s gotten worse. Is the landlord responsible for fixing this and the damaged carpet, or is this on me to handle?

In Dubai's climate, the persistent high humidity and year-round reliance on air conditioning create a perfect environment for mold growth, particularly in enclosed spaces like closets where condensation can form. The responsibility for remediation in a rental apartment is a common point of contention.

Under the Dubai Rental Law (Law No. 26 of 2007), the landlord is generally responsible for maintaining the structural integrity of the property and addressing issues arising from inherent building defects, such as leaking pipes within the walls or faulty external waterproofing that leads to moisture intrusion. If the mold in your Discovery Gardens apartment is a result of such a structural issue, the landlord is obligated to address both the root cause and the resulting damage, including mold remediation and carpet replacement.

However, tenant responsibilities include maintaining adequate ventilation to prevent condensation. If the mold growth is deemed to be a result of tenant negligence—such as severely obstructing airflow in the closet, failing to use the AC to control humidity, or failing to report a minor leak in a timely manner—the cost of remediation could fall to you.

Given the extensive growth you've described, a professional inspection is critical. Our certified inspectors at Saniservice can conduct a comprehensive assessment to determine the moisture source, identify the mold species, and provide a definitive report on the cause. This objective evidence is essential for negotiating responsibility with your landlord. Do not attempt to remove significant mold growth yourself, as improper handling can aerosolize spores and spread contamination.
