Is landlord responsible for black mold in Dubai apartment?« Back to Previous Page

The ceiling in my master bedroom closet in my Al Barsha apartment has a growing black mold patch. It started as a small spot after the heavy dew last month but has spread a lot. I’ve told my landlord about it twice, but he just says it's from the AC and to keep the door open. Who is actually responsible for getting this professionally cleaned, me or the landlord?

Based on UAE rental law, specifically Law No. (26) of 2007, landlords are legally obligated to maintain the property in a habitable condition and are responsible for all major structural and maintenance repairs. This includes addressing issues like mold growth that stem from inherent building defects, such as leaking pipes, faulty waterproofing, or inadequate ventilation systems. The persistent high humidity and condensation issues common in Dubai's climate, especially when coupled with year-round AC use, often exacerbate these underlying problems.
Your landlord's assertion that it is "from the AC" is a significant red flag. While occupant habits can contribute to humidity, a professional inspection is required to determine the root cause. If the mold is a result of a maintenance issue like a roof leak, a leaking AC condensation drain pipe inside the ceiling void, or insufficient insulation leading to condensation, the financial and remedial responsibility falls squarely on the landlord. Given that the patch is black, growing, and originated after a weather event, this is a serious case that requires immediate professional assessment. Self-cleaning is not advised, as improper handling can spread toxic spores and pose health risks. We strongly recommend you formally request, in writing, that the landlord arranges for a certified mold inspection to identify the moisture source. This report will definitively establish liability.
