Is landlord responsible for black mold in Dubai apartment?« Back to Previous Page

We've lived in our Jumeirah Village apartment for 2 years and just noticed a spreading patch of black, fuzzy mold in the back corner of the master bedroom closet. It's been extra humid the last few months and the musty smell in that room is really strong now. Is this something I need to handle myself or is my landlord responsible for the inspection and removal?

Based on the UAE Civil Code, specifically Federal Law No. 5 of 1985, a landlord is obligated to deliver and maintain the leased property in a habitable condition. This includes addressing structural and maintenance issues that affect the health and safety of the tenant. The black mold you described in your Jumeirah Village apartment, exacerbated by Dubai's high humidity and continuous AC operation leading to condensation, is a significant habitability and health concern. Therefore, your landlord is typically responsible for the inspection and remediation of this issue, as it is considered a defect in the property that impairs its use.

However, it is critical to formally notify your landlord or property management company in writing immediately. Provide clear photographs and a description of the extent of the mold growth and the persistent musty odor. This documentation is essential for establishing the severity of the problem.

Given the description of a spreading patch and a strong musty smell, this is not a minor issue for a DIY solution. Improper handling can aerosolize spores and spread contamination. A professional inspection is mandatory to determine the moisture source (e.g., a hidden pipe leak, condensation from AC ducts, or envelope penetration) and the full extent of the infestation, which may be present within the wall cavity.

For a definitive assessment and to ensure the remediation is handled correctly and safely according to industry standards, I strongly recommend you contact a professional environmental services company. Saniservice specializes in mold inspection, testing, and remediation in the UAE climate. They can provide a comprehensive report that can be used to formally engage your landlord.
