Is landlord responsible for black mold in Dubai rental?« Back to Previous Page
|
My kids have been coughing and I suspect it might be from the black mold I just found spreading along the wall behind our bedroom wardrobe. We've lived here for 2 years and just noticed it, probably from the humidity. I’ve already informed the landlord, but they’re saying it's our fault for not ventilating properly.
Are landlords in Dubai legally required to handle this kind of mold remediation, or is the cleanup and cost really on us as tenants?

Based on the UAE Civil Code, specifically Federal Law No. 5 of 1985, the landlord is generally responsible for the property's structural integrity and for addressing issues that affect its habitability. This includes problems arising from inherent building defects, such as faulty waterproofing, leaking central AC systems, or structural cracks that allow moisture ingress.
In your case, the mold spreading behind a fixed wardrobe suggests a significant, hidden moisture source. This is unlikely to be caused by simple daily activities and more indicative of a pre-existing or structural issue, such as a leaking pipe within the wall or inadequate external waterproofing. The landlord's obligation is to investigate and rectify this source of moisture. The subsequent mold remediation required to make the property safe again is a direct consequence of that underlying issue and therefore typically falls under their responsibility. However, the landlord may argue tenant liability under Article 20 of the Dubai Rental Law, which states tenants must maintain the property and use it in a proper manner. In Dubai's climate, with high humidity and year-round AC use, proper ventilation is crucial to manage condensation. If the lack of ventilation is proven to be the sole cause, you could be held partially liable. Given the location and extent you describe, this seems improbable. We strongly recommend you do not attempt to clean this yourself. Disturbing black mold (often Stachybotrys chartarum) releases mycotoxins and can exacerbate health issues, like the coughing your children are experiencing. A professional inspection is essential to identify the exact moisture source, assess the contamination level, and provide a legally defensible report for your landlord.
