Is landlord responsible for black mold on exterior wall?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a large patch of black mold behind our wardrobe in the master bedroom, which is on the exterior wall. It's been humid lately and I'm worried it's been growing there for a while. Since we didn't cause it with any spill or leak, is the landlord responsible for the cleanup and repainting, or is this on us as tenants?

Based on the details you've provided, this is a significant structural and maintenance issue, and in the UAE, the responsibility for its remediation almost certainly falls on the landlord.

The black mold on the exterior wall behind the wardrobe is a classic symptom of condensation, exacerbated by Dubai's high humidity and the constant use of air conditioning. The exterior wall is a common point for thermal bridging, where the difference between the hot, humid outdoor air and the cool interior air causes moisture to condense within or on the interior surface of the wall. This hidden, persistent dampness creates the perfect environment for mold growth, which was likely developing slowly over time.

Under standard Dubai rental law (Law No. 26 of 2007), the landlord is obligated to maintain the property's structure and ensure it is habitable. This includes addressing fundamental building envelope issues like inadequate insulation or waterproofing on external walls that lead to condensation and mold. As this was not caused by tenant negligence (e.g., an internal spill, lack of ventilation, or failure to use the AC), the remediation and repair costs are the landlord's responsibility.

However, it is critical to handle this correctly. Do not attempt to clean it yourself with bleach, as this can exacerbate spore release and only removes surface discoloration, not the root cause. The landlord must address the moisture source first.

We strongly recommend you inform your landlord in writing immediately and request a professional mold inspection. A certified inspector, like those from Saniservice, can conduct moisture mapping and air quality testing to identify the exact condensation source, assess the extent of the infestation within the wall cavity, and provide a legally sound report for the landlord. This evidence is crucial for ensuring proper and complete remediation, which will involve moisture correction, professional mold removal, and repainting with antimicrobial coatings.
