Is landlord responsible for black mold remediation?« Back to Previous Page

Our master bedroom in this Marina apartment has had a lingering damp smell for a couple of months now, and I finally pulled the wardrobe away from the wall to find a huge patch of black mold hidden behind it. The dehumidifier runs constantly but doesn't seem to help. Is the landlord responsible for the remediation and repairs, or is this on me as the tenant to fix?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for the structural integrity and maintenance of the property's major systems. This includes addressing issues related to the building envelope that lead to water intrusion, which is the most common cause of the black mold you've described.

In a Marina apartment, the persistent humidity and constant AC operation create significant condensation risks. The mold behind your wardrobe strongly suggests a hidden leak from an internal pipe, a faulty AC condensation drain line, or, more critically, a breach in the building's exterior waterproofing. The landlord is obligated to investigate and repair this source of moisture, as it is a fundamental building defect. The subsequent mold remediation and repairs to any damaged walls or fixtures should also be their responsibility.

However, your obligation as a tenant is to promptly report the issue and provide access. The continuous use of a dehumidifier indicates you've been proactive about the humidity, which is in your favor. For a case of this severity, a professional inspection is non-negotiable to accurately identify the moisture source and the full extent of contamination. Remediation is a technical process involving containment, air scrubbing, and antimicrobial treatment to ensure it is eliminated safely and does not return.

We strongly recommend you formally notify your landlord immediately and request a professional assessment.
