Is landlord responsible for black mold removal in Dubai rental?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold that's been slowly spreading across the ceiling in our master bedroom closet here in Jumeirah. We’ve lived here for 2 years and just noticed it when we were doing our deep cleaning before Eid. Is this something I need to fix myself, or is the landlord legally responsible for the remediation costs?

In Dubai, the landlord is typically responsible for addressing structural issues that cause black mold, such as leaks in the roof, walls, or plumbing, as well as faulty AC systems that cause condensation. This falls under their obligation to provide a habitable property under Law No. 26 of 2007, which regulates the relationship between landlords and tenants.
Your situation in Jumeirah is common due to our high humidity and year-round AC use, which can lead to condensation buildup in enclosed, poorly ventilated spaces like closets. The health concerns you've noted are valid; prolonged exposure to certain mold types can cause respiratory irritation, especially in children. First, formally notify your landlord in writing about the mold and its suspected cause (e.g., a potential leak or condensation issue), as this starts a legal paper trail. They are obliged to investigate and fix the source of the moisture. For remediation of the mold itself, the responsibility can depend on the cause. If it's due to a structural fault, the landlord should cover the full cost. If it's deemed due to tenant lifestyle (like lack of ventilation, which is unlikely for a closet), the cost might be shared, but this is less common for such locations. Given the spread and the health symptoms, a professional inspection is wise to identify the exact moisture source and mold type. DIY removal is not recommended for a spreading patch, as improper cleaning can aerosolize spores. A proper remediation involves fixing the water source, containing the area, and removing the contaminated materials, which is best handled by experts. The Dubai Municipality has specific guidelines for habitability that support your request for a resolution. |
