Is landlord responsible for black mold treatment?« Back to Previous Page

My kids have been coughing for a couple of weeks and I finally found a patch of black mold behind the wardrobe in our master bedroom in Silicon Oasis. It's been really humid lately and I think the AC might not be drying the air enough. Who is responsible for getting this professionally treated and paying for it, me as the tenant or my landlord?

In the UAE, the responsibility for treating black mold in a rental property is typically defined by the lease agreement and Dubai's rental laws. The landlord is generally responsible for the structural integrity and maintenance of the property, including issues arising from inherent building defects, such as faulty AC systems, leaking pipes, or inadequate waterproofing that lead to dampness and mold growth. The tenant is usually responsible for maintenance resulting from their own negligence or lifestyle, such as failing to use the AC properly or not ventilating the property adequately.

Given your situation in Silicon Oasis, the recent high humidity is a significant factor. If the mold growth is a direct result of an underperforming air conditioning system that is not effectively dehumidifying the air—a critical function of AC in Dubai's climate—this could be considered a maintenance issue for the landlord to address. The black mold behind the wardrobe suggests a condensation issue, often stemming from a thermal bridge in the wall or insufficient climate control.

However, immediate action is required due to the health symptoms your children are experiencing. Black mold (likely Stachybotrys chartarum) can produce mycotoxins and is a serious health hazard. We strongly recommend you first inform your landlord in writing about the issue, as they may be obligated to rectify the cause. For your family's safety, do not attempt to remove it yourself, as improper remediation can aerosolize spores and worsen contamination.

A professional inspection is essential to determine the root cause, the full extent of the contamination (which is often hidden within walls or under floors), and to provide a legally valid report. Our certified team at Saniservice can conduct a comprehensive assessment, including moisture mapping and air quality testing, to identify the source and provide a remediation protocol. This report is crucial for determining liability between tenant and landlord.
