Is landlord responsible for Dubai rental mold causing cough?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold I just found behind our bedroom wardrobe in our Jumeirah Village rental. It’s been getting worse since the humidity spiked a couple of months ago. I’ve told my landlord, but he says it’s our fault for not ventilating the room properly. Are landlords in Dubai legally responsible for fixing this kind of mold issue, or is it really on the tenant?

Based on Dubai's rental laws, specifically Law No. 26 of 2007 and its amendments, the landlord is unequivocally responsible for maintaining the property's structural integrity and ensuring it is habitable. This includes addressing issues like persistent black mold (Stachybotrys chartarum), which is often a symptom of a underlying building defect such as leaking pipes, faulty waterproofing, or inadequate insulation—all of which are the landlord's legal obligation to rectify.

While tenants are responsible for general day-to-day upkeep and ensuring adequate ventilation, the high humidity levels in Dubai, especially during summer months, can cause condensation that exacerbates hidden mold growth. The presence of black mold, coupled with your children's respiratory symptoms (coughing is a common reaction to mycotoxins), indicates a serious indoor air quality issue that goes beyond simple tenant ventilation. Your landlord's assertion is likely an attempt to shift responsibility.

For a definitive resolution, you require a professional inspection. A certified mold assessor can identify the exact species and the root moisture source. This technical report is crucial evidence to formally present to your landlord and, if necessary, the Dubai Land Department's Rental Dispute Center. The inspection will determine if the cause is a structural defect (landlord's duty) or a tenant-related ventilation issue.

Do not attempt to remediate this yourself, as improper handling can aerosolize spores and worsen the contamination.
