Is landlord responsible for hidden mold removal?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for 2 years and just noticed a huge patch of black mold behind our bedroom wardrobe. It must have been growing there for ages, hidden from view. The recent humidity has made the whole room smell damp and my husband's allergies have been awful. Are we responsible for paying for the mold removal, or is this something our landlord has to handle?

Under Dubai rental law, the landlord is typically responsible for repairs related to the structural integrity and maintenance of the property, which often includes issues like hidden mold resulting from building envelope defects, such as leaking pipes in walls, faulty external waterproofing, or rising damp. You are generally responsible for issues stemming from your own occupancy, like interior condensation from AC settings or lack of ventilation.

Given the mold was hidden behind a fixed wardrobe and the recent humidity has exacerbated it, the source is likely a pre-existing leak or insufficient insulation. Document everything immediately with clear photos and videos. Formally notify your landlord in writing (email is best) about the issue, including your evidence and mentioning the health impact.

For a case this severe, a professional inspection is critical to determine the moisture source. This is not just surface cleaning; the root cause must be fixed. A proper assessment will identify if the origin is a landlord-responsible structural issue or an internal environmental one. In JVC, with its high humidity and reliance on AC, condensation can be a factor, but a large hidden patch often points to a construction-related water intrusion.

If the landlord disputes responsibility, you can file a case with the Rental Dispute Center (RDC) in Dubai. They will review the evidence, including any independent professional reports on the moisture source, to determine liability. Do not attempt removal yourself, as disturbing it can spread spores and worsen allergy symptoms.
