Is landlord responsible for mold and our cough?« Back to Previous Page

The AC in our bedroom closet has been leaking a little for a few months, and now I’ve found a patch of black mold on the back wall and our clothes. My toddler and I have both had a stubborn cough for the last couple of weeks that won’t go away. Is my landlord legally responsible for the mold remediation and our medical bills, or is this on me because I didn’t report the leak sooner?

Under UAE tenancy law, your landlord is generally responsible for maintaining the structural integrity of the property, which includes fixing AC leaks that lead to mold growth. The key factor is whether you reported the leak in a timely manner. Since you've noted it has been leaking for a few months, you must formally notify your landlord in writing (email is best for a paper trail) about both the leak and the mold immediately. This officially puts the responsibility on them to act.

Given the visible mold and your toddler's persistent cough, this is a serious health concern. Mold spores from a closet can easily circulate into the bedroom air. In Dubai's high humidity, an AC leak creates a perfect environment for mold, and prolonged exposure can cause or exacerbate respiratory issues like the cough you describe.

For your health and to strengthen your case, a professional inspection is critical. A certified mold assessment will confirm the species and the source of the moisture, providing documented evidence that links the landlord's maintenance issue (the leaking AC) to the biological hazard. This report is powerful evidence for your landlord and, if necessary, the Dubai Rental Dispute Center.

While the landlord is responsible for remediation of the property itself, medical costs are a more complex matter. You would need to establish a direct causal link through a doctor's report. Your first step is to document everything: photos of the leak and mold, copies of all communication with the landlord, and a visit to a doctor for your and your toddler's coughs.
