Is landlord responsible for mold behind bedroom wall?« Back to Previous Page
|
The wall behind our wardrobe in the master bedroom feels damp and cold to the touch, and we just found a patch of black mold spreading there. It's been getting worse since the heavy humidity a few weeks ago. We're renting an apartment in Jumeirah Lakes Towers and our contract is pretty standard.
Are we responsible for the cleanup, or is this something the landlord needs to fix since it's inside the wall?

In Dubai's rental market, the responsibility for mold remediation depends on the source of the moisture. If the dampness and mold are due to a structural issue like a leaking pipe inside the wall, a faulty external seal, or inadequate insulation—all inherent building defects—then it is unequivocally the landlord's responsibility to repair the cause and remediate the mold.
However, if the issue is determined to be a result of tenant behavior, such as a lack of ventilation leading to condensation buildup, the responsibility could shift. Given your description of a cold wall in JLT, this is a classic case of thermal bridging and condensation, exacerbated by our high humidity and year-round AC use. The wall likely gets cold from the AC, and humid air condenses on it, especially behind a wardrobe that restricts airflow. This is a very common issue in Dubai apartments. Your first step is to formally notify your landlord or property management company in writing, with photos, and request an immediate inspection to determine the moisture source. Do not attempt to clean it yourself, as disturbing it can spread spores. A professional inspection is crucial to identify the root cause. For verification, refer to your tenancy contract and the Dubai Rental Law. Generally, the law mandates landlords provide a property in habitable condition, which includes addressing structural defects that cause health hazards like mold. The landlord is typically responsible for the building's main structure and systems. Since this is inside the wall, you have a strong case that this is a structural issue they must fix. |
