Is landlord responsible for mold damage from damp wall?« Back to Previous Page

We’ve been in our Jumeirah Village Circle apartment for almost a year, and I just pulled out my winter clothes from the back of the built-in wardrobe to find several jumpers covered in black mold spots. The wall behind the wardrobe feels slightly damp to the touch, and the musty smell is really strong. Since I’m a tenant, am I responsible for cleaning and replacing my damaged belongings, or is the landlord obligated to fix the dampness in the wall that caused this?

Under Dubai rental law (Law No. 26 of 2007), the landlord is generally responsible for the structural integrity of the property, which includes fixing the source of dampness in the wall. This type of moisture intrusion is considered a major defect that affects the property's habitability, and it is their obligation to repair it.
As a tenant, your responsibility is to report the issue in writing to the landlord or property manager immediately. You should document the damage thoroughly with clear photographs and videos showing the mold, the damp wall, and your affected belongings. Do not dispose of any damaged items yet, as they are evidence. For your personal possessions, the landlord's responsibility for replacement can depend on your tenancy contract and whether the damage is proven to be a direct result of their failure to maintain the property. This often requires negotiation. Given Dubai's high humidity, this dampness is likely due to a leaking pipe, capillary rise from a faulty damp-proof course, or condensation from inadequate insulation—all structural issues. A professional inspection is crucial to identify the exact moisture source behind the wall. A certified mold assessor can provide a detailed report that documents the cause and extent of the problem, which becomes essential evidence for discussions with your landlord. Until the root cause is fixed by the landlord, any cleaning you do yourself will be temporary, as the mold will return. |
