Is landlord responsible for mold from AC leak?« Back to Previous Page

My kids have been coughing more than usual and I just found a bunch of black spots behind our bedroom wardrobe. The AC unit is right by that wall and it's been constantly dripping, so I think the humidity has been causing this mold to grow for a while. Our building is in Jumeirah Village Circle and the landlord is saying it's our fault for not ventilating properly. Who is legally responsible for the mold removal and fixing the AC in this situation, us or the landlord?

Based on the details you've provided, the situation in your JVC apartment is a common yet serious issue in Dubai's climate. The constant dripping from the AC unit is the primary source of moisture, which in our high humidity environment, is the fundamental catalyst for mold growth. Black spots behind furniture are a strong visual indicator of a significant, ongoing problem.

Legally, under UAE tenancy law, the responsibility for maintenance of major fixtures and appliances, including the air conditioning system, typically falls upon the landlord. A leaking AC unit is a structural or mechanical failure that the landlord is obligated to rectify. Your duty as a tenant is generally to report such issues in a timely manner and to maintain reasonable ventilation, but you are not responsible for the repair of the appliance itself. The landlord's claim may not hold if the root cause is a faulty AC.

However, a professional inspection is absolutely crucial here for two reasons. First, to determine the full extent of the mold contamination, which often spreads inside walls and ceiling cavities behind what is visible. Second, to officially document the source of the moisture. We use thermal imaging and moisture meters to pinpoint the exact leak source and assess the damage, providing a certified report that can be used to definitively establish liability with the landlord.

For your family's health, especially with children exhibiting respiratory symptoms, immediate action is required. I strongly recommend you cease using that AC unit and request a professional mold inspection.
