Is landlord responsible for mold from AC leak?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a patch of black mold spreading from behind the wardrobe in the master bedroom. The AC unit is right on the other side of that wall and it's been leaking a bit for a while. I'm worried it's getting worse, but I'm not sure if this is something I need to handle myself or if it's my landlord's responsibility to fix and inspect. Who is legally responsible for arranging and paying for a professional mold inspection in this case?

Based on the details you've provided, this situation is almost certainly the legal responsibility of your landlord to rectify. The core issue is the leaking AC unit, which is a fixture and a fundamental part of the property's provided amenities. Under UAE tenancy law, specifically Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai, the landlord is obligated to maintain the property in a habitable condition and is responsible for all structural and major maintenance issues. This includes the repair and proper functioning of central air conditioning systems.

The persistent moisture from the AC leak has created the ideal conditions for mold growth, a common issue in Dubai's humid climate where condensation and AC-related dampness are primary catalysts. The mold behind the wardrobe is a direct consequence of the landlord's failure to address the leak. A professional inspection is critical, as the visible patch is likely just the surface manifestation; the moisture will have penetrated the wall structure, and spores may have spread into the AC system itself.

You should formally notify your landlord in writing of the issue and the required professional mold inspection and remediation. Do not attempt to remove it yourself, as improper handling can aerosolize toxic spores and exacerbate the problem.

For a comprehensive assessment that includes moisture mapping, air and surface sampling, and a detailed report for your landlord, I recommend contacting our specialists at Saniservice. Call 800-MOLDS (800-66537) or email hello@saniservice.com. Our certified inspectors can identify the full extent of the contamination and provide the documentation needed to ensure your landlord undertakes the necessary and correct remedial actions.
