Is landlord responsible for mold from leak in closet?« Back to Previous Page

Our master bedroom closet on the outside wall has been smelling damp for a couple of months, and I just pulled out a stack of shoes to find black fuzzy mold growing all over the back wall. It's the rainy season and I'm in an older building in Jumeirah. Who is responsible for the mold removal and fixing the probable leak – me as the tenant or my landlord?

Based on the UAE Civil Code, specifically Federal Law No. 5 of 1985, the responsibility for structural repairs and addressing issues stemming from the building's core infrastructure falls upon the landlord. A leak from an external wall, particularly during the rainy season in an older Jumeirah building, is almost certainly a structural issue. Therefore, your landlord is legally obligated to address the source of the water intrusion, which is the root cause of the mold growth.

The damp smell and subsequent visible black mold are direct consequences of this moisture breach. Dubai's high humidity, combined with condensation from year-round AC use and seasonal rains, creates a perfect environment for rapid mold proliferation once a water source is present. The mold on the wall surface is a symptom; the leak is the disease that must be cured first.

However, as the tenant, you have a responsibility to report the issue promptly and allow access for inspection and repairs. Mitigating further damage to your personal belongings, such as removing the affected shoes, is also advised.

For a definitive assessment, a professional inspection is critical. We must identify the exact source of the leak (e.g., failing sealants, cracks, or capillary action) and the full extent of the mold contamination, which can often spread behind walls. DIY attempts can be ineffective and may exacerbate spore dispersal.

I strongly recommend you formally notify your landlord immediately and request they engage a professional remediation company like Saniservice. Our certified experts can conduct a thorough investigation, provide a detailed report for your landlord, and execute the necessary containment, removal, and hygienization protocols to ensure the closet is safely restored.
