Is landlord responsible for mold in apartment closet?« Back to Previous Page

Our master bedroom closet in our Jumeirah Village Circle apartment has had a weird damp smell for the last couple of months, and I finally pulled everything out to find black mold growing on the back wall. It's been really humid, but we run the AC constantly. Is the landlord responsible for fixing the cause and cleaning this, or is this considered our problem because it's inside a closet?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for maintaining the structural integrity of the property. This includes addressing issues with the building envelope, such as faulty external waterproofing, leaking pipes within the walls, or a defective AC system that is causing condensation. The presence of mold on an internal wall, particularly in a high-humidity environment like Dubai, often points to an underlying moisture source that is the landlord's obligation to repair.

However, the responsibility for remediation can become a gray area. If the mold growth is determined to be a direct result of tenant behavior—such as inadequate ventilation, drying clothes indoors, or failing to use the AC properly to control humidity—the cost of cleaning may fall to the tenant. In Jumeirah Village Circle, where humidity is a constant challenge, persistent AC use is actually recommended to manage indoor moisture levels and prevent condensation, which is a primary cause of mold.

Given that the mold is established and has caused a persistent odor, we strongly recommend a professional inspection. Our certified experts can conduct a comprehensive assessment to identify the precise source of the moisture—whether it's a hidden leak, thermal bridging causing condensation, or an issue with the AC drain line. This report is crucial evidence for determining liability. The remediation itself must be performed by professionals like Saniservice to ensure it is removed safely and effectively, preventing recurrence and potential health issues.
