Is landlord responsible for mold in humid rental?« Back to Previous Page

We've lived here for 2 years and just noticed a bunch of black, speckled patches spreading in the back of the bedroom closet where we store our winter clothes. It's been extra humid lately and I'm worried it's black mold. My landlord says it's just condensation and not his problem to fix. Who is legally responsible for testing and removing this in a rental, especially if it's making my family feel unwell?

Landlords in Dubai are generally responsible for maintaining the property's structure and ensuring it is habitable, which includes addressing issues like mold caused by structural defects or faulty AC systems. However, if the mold is a direct result of tenant behavior—such as inadequate ventilation, failing to use the AC to control humidity, or creating excess moisture—the responsibility may shift.

Given Dubai's high humidity, condensation is a common trigger. The black speckled patches you describe, especially in a closet against an exterior wall, are a classic sign of a condensation issue. While not all black mold is the notorious Stachybotrys, any widespread visible growth warrants attention.

Your first step is to formally notify the landlord in writing (email is best), detailing the issue and mentioning any health symptoms. They are typically obligated to investigate the source, which is key. If the cause is a leaking pipe, insufficient insulation, or a malfunctioning AC unit, remediation is their responsibility. If they refuse, you can file a complaint with the Dubai Rental Dispute Center (RDC).

For your health and to strengthen your case, a professional inspection is advisable. An independent assessment can identify the mold species and, crucially, pinpoint the moisture source. This evidence is powerful in any dispute. In the meantime, improve airflow to the closet, consider a dehumidifier, and avoid storing damp items there. Do not attempt to clean it with bleach, as this can aggravate spores without solving the moisture problem.
