Is landlord responsible for mold in windowless bedroom?« Back to Previous Page

My kids have been coughing a lot and I suspect it's because of a black mold patch I've found behind the wardrobe in our master bedroom. We've lived in this Jumeirah Village Triangle apartment for 2 years and just noticed it when we moved the furniture. The landlord is saying it's our fault for not ventilating properly, but the room doesn't even have a window. Are we responsible for the mold remediation costs, or is this the landlord's duty to fix?

Under Dubai's rental law, the landlord is typically responsible for addressing structural defects and maintaining the property to a habitable standard. A persistent mold issue in a windowless bedroom is a strong indicator of inadequate ventilation or a hidden moisture source, both of which fall under the landlord's maintenance obligations.

Your landlord's claim about improper ventilation is problematic, as a room without a window cannot be ventilated by a tenant. This inherent design flaw is a building issue, not a tenant-caused one. The high humidity and constant AC use required in Dubai's climate make such spaces prime for condensation and mold growth, which is a known health concern.

Document the issue thoroughly. Take clear, dated photos and videos of the mold patch and the entire room, highlighting the lack of a window. Send a formal written notification (email is best for a paper trail) to the landlord or property management company, stating the problem and its likely cause. Mention that your children's persistent coughing coincides with the discovery.

For a definitive cause, a professional inspection is advised. An expert can identify the moisture source—whether it's rising damp, a leak from an adjacent bathroom, or condensation from the AC—and provide a report. This documented evidence is crucial. If the landlord remains uncooperative, you can file a formal complaint with the Rental Dispute Settlement Center (RDSC) in Dubai, as a mold problem of this nature breaches the implied warranty of habitability.
