Is landlord responsible for mold inspection after rain?« Back to Previous Page

My kids have been coughing more than usual, and I’ve just found patches of black mold behind the wardrobe in our master bedroom. We’ve been in this JVC villa for almost three years and never had an issue until after the heavy rains a few weeks ago. Is getting a professional mold inspection the landlord's responsibility to handle, or is this on me as the tenant?

Under Dubai's rental law, the landlord is generally responsible for maintaining the structural integrity of the property, which includes addressing leaks and water ingress that lead to mold. Since the issue appeared after heavy rains, the source is likely a leak or seepage through the external walls or roof, which falls under the landlord's maintenance obligations.

You should formally notify your landlord in writing about the mold and its suspected cause from the recent rains. They are typically obligated to arrange for the repair of the leak and the subsequent remediation. However, the responsibility for the inspection itself can be a grey area. A professional inspection is crucial to identify the exact moisture source and the mold type, as not all black mold is the toxic Stachybotrys species commonly feared.

Given that your children are experiencing respiratory symptoms, do not attempt to clean it yourself. Disturbing the mold can release a large number of spores into the air, potentially worsening the situation. A proper inspection involves moisture mapping, air and surface sampling sent to a microbiology lab for analysis, and a clear remediation protocol. You can request this, but the cost may be negotiated with the landlord as it directly relates to their responsibility to provide a habitable property. For a case with visible growth and health symptoms, a professional assessment is strongly advised to resolve the issue safely and correctly.
