Is landlord responsible for mold inspection in Dubai?« Back to Previous Page

We've lived here for 2 years and just noticed a patch of black mold in the corner of our master bedroom closet, which is on an exterior wall. It wasn't there during the last inspection, and with all the humidity lately, it seems to be getting bigger. I'm worried about our health and the damage to our clothes. Is my landlord in Dubai legally responsible for arranging and paying for a professional mold inspection, or is that on me as the tenant?

Based on the UAE Civil Code and standard tenancy contract provisions in Dubai, the responsibility for structural maintenance and issues arising from the building's fabric typically falls upon the landlord. This includes problems like water seepage through exterior walls or faulty AC systems that lead to condensation and subsequent mold growth. Since you mentioned the mold is on an exterior wall and has appeared after a period of high humidity, this strongly suggests an underlying moisture intrusion issue that the landlord is likely obligated to address.

However, the tenant is responsible for maintaining the property's cleanliness and ensuring adequate ventilation to prevent humidity buildup, especially given Dubai's climate where year-round AC use can create significant condensation if not managed properly.

For a definitive determination of responsibility, a professional inspection is critical. A certified mold inspector can identify the moisture source, assess the extent of the growth, and provide an evidence-based report. This report is essential for formally notifying your landlord and delineating responsibility.
