Is landlord responsible for mold inspection in JVC apartment?« Back to Previous Page
|
We've lived in our Jumeirah Village Circle apartment for 2 years and just noticed a patch of black mold spreading from the corner of our bedroom ceiling. It's gotten worse since the humidity spiked last month, and we're starting to worry about our toddler's allergies. Is the landlord responsible for arranging and paying for a professional mold inspection, or is that on us as tenants?

Under Dubai rental law, the landlord is typically responsible for maintaining the structural integrity of the property, which includes addressing leaks in the roof or external walls that lead to mold. Since the mold is on the ceiling and worsened with humidity, this strongly suggests a persistent moisture issue like a leak or significant condensation, placing responsibility on the landlord.
You should formally notify your landlord in writing about the mold, including clear photos showing its progression from the ceiling corner. Mention your toddler's allergy symptoms, as this elevates the issue from cosmetic to a potential health concern. They are obligated to address the source of the moisture. Given the spread and the health concern, a professional inspection is recommended to identify the exact moisture source and mold type. Humidity here causes condensation within AC ducts and behind walls, which a proper inspection can pinpoint. The landlord should arrange and pay for this, as it's part of diagnosing a structural defect. If they refuse, you may need to escalate to the Rental Dispute Center (RDC) in Dubai, but formal written notification is always the first step. For your safety during this process, keep the room well-ventilated and limit your toddler's exposure to the affected area. |
