Is landlord responsible for mold inspection in rental villa?« Back to Previous Page

Our master bedroom closet, which is on the outside wall of our villa in Jumeirah, has started to feel really damp. I pulled out some winter clothes I stored a few months ago and found several jackets with dark greenish spots on them. We’ve been running the AC constantly, but the musty smell just won't go away. Is the landlord responsible for arranging and paying for a professional mold inspection in this case, or is this on me as the tenant?

In the UAE, specifically Dubai, the responsibility for mold issues in a rental property is primarily governed by the rental contract terms and Dubai Law No. 26 of 2007, known as the 'Law Regulating Relationship between Landlords and Tenants in the Emirate of Dubai'. The law stipulates that the landlord is responsible for maintaining the property's structural integrity and ensuring it is habitable. The dampness you describe on an exterior wall in Jumeirah strongly suggests a potential structural issue, such as water infiltration from a leaking pipe, faulty sealant, or a crack in the building envelope, which is unequivocally the landlord's responsibility to investigate and rectify.

However, the tenant is responsible for damages resulting from misuse or negligence. Given Dubai's high humidity levels and the constant AC operation required, a tenant must ensure proper ventilation to mitigate condensation, which can be a contributing factor. The presence of a persistent musty smell and visible growth on contents indicates a significant and active problem that has likely penetrated beyond the surface.

For a definitive determination of liability and the source of the moisture, a professional inspection is non-negotiable. DIY assessments are insufficient. A certified mold inspector will conduct moisture mapping, thermal imaging, and air quality testing to identify the exact source—whether it's structural (landlord's duty) or due to condensation from occupant activity (a shared responsibility).

We strongly advise you to formally notify your landlord or property management company of the issue in writing, including photographs, and request a professional mold inspection.
