Is landlord responsible for mold-related health costs in Dubai?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a huge patch of black mold behind the wardrobe in the master bedroom, which must have been growing for ages. My youngest has had a persistent cough for a month that we can't shake, and I'm starting to worry it's connected. The landlord is saying it's our fault for not ventilating properly, but the AC is always on. Who is legally responsible for the cleanup and any health-related costs here, the tenant or the landlord?

Under Dubai Law No. 26 of 2007 (as amended), the landlord is generally responsible for maintaining the structural integrity of the property and addressing issues inherent to the building itself. Mold resulting from a pre-existing water leak, faulty insulation, or a defective AC system that causes condensation within the walls is the landlord's legal responsibility to remediate.
However, the tenant is responsible for maintaining clean and hygienic living conditions through adequate ventilation. With the AC always on, the issue is likely not a lack of cooling but a lack of fresh air exchange, which is a common oversight in Dubai's climate. The landlord may argue that daily ventilation (opening windows when outdoor humidity is lower) was not performed, contributing to the problem. For a hidden issue of this scale, a professional inspection is critical to determine the moisture source. If the inspection report identifies a structural or systemic fault, the remediation cost falls on the landlord. Health-related costs are more complex and typically require a direct medical diagnosis linking the condition to the specific mold, which is difficult to establish. Your first step is to formally notify the landlord in writing with photos. Request a professional mold assessment to identify the root cause. Do not attempt to clean a large patch yourself, as improper disturbance can spread spores. For your child's persistent cough, consult a pediatrician and inform them of the mold discovery. |
