Is landlord responsible for mold remediation and damaged items?« Back to Previous Page

Our master bedroom closet in our Marina apartment has had a damp smell for a couple of months, but now I’ve pulled out some winter clothes and found a patch of black, fuzzy mold spreading on the back wall. We run the AC constantly, but the humidity is just overwhelming. Is my landlord legally required to handle the remediation and replace our damaged belongings, or is this considered our fault for not ventilating properly?

Based on the conditions you've described in your Marina apartment, this is a serious issue that requires immediate attention. The presence of black, fuzzy mold indicates an active moisture problem, likely exacerbated by the high ambient humidity in Dubai, which condenses on cooler surfaces, especially within closets on exterior walls. While AC is running, if the unit is undersized, set too high, or not properly maintained, it can fail to adequately dehumidify the air, creating these perfect conditions for mold growth.

Under UAE tenancy law, specifically Law No. (26) of 2007, the landlord is fundamentally responsible for maintaining the property's structural integrity and ensuring it is habitable. This includes addressing the source of moisture ingress, which is the root cause of your mold problem. Remediation of the mold itself and the repair of the affected structure are therefore typically the landlord's legal obligation. However, the liability for damaged personal belongings, such as your winter clothes, can be more complex and is often dictated by the specific terms of your tenancy contract. You must demonstrate that the damage was a direct result of the building's fault (e.g., a hidden leak, inadequate insulation) and not solely from occupant lifestyle.

We strongly advise against attempting to clean this yourself, as improper handling can aerosolize toxic spores. The situation requires a professional inspection to identify the exact moisture source, assess the extent of contamination, and provide a legally defensible report for your landlord.
