Is landlord responsible for mold remediation cost?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold I just found in the corner of our master bedroom closet. It's been extra humid lately and this wall is an exterior one in our Marina apartment. Who is responsible for the cost of mold remediation here, me as the tenant or my landlord, especially since it might be due to a building issue?

This is a very common and important question here in Dubai, especially in coastal areas like Marina where high humidity is a constant battle. Based on your description, there's a strong possibility your landlord is responsible for the remediation cost.

The key factor is the source of the moisture. Under typical UAE rental law (Law No. 26 of 2007), the landlord is obligated to maintain the property in a habitable condition. This includes addressing structural defects that lead to issues like water infiltration or faulty AC systems that cause condensation—common causes of mold on exterior walls. Since you mentioned it's on an exterior wall and humidity has been high, this points to a potential building envelope issue or inadequate insulation, which is the property owner's responsibility to rectify.

However, if the mold growth was caused by tenant behavior—like severely inadequate ventilation, failing to use the AC to control humidity, or an internal water spill that wasn't reported and dried promptly—the cost could fall to you.

Given that your children are experiencing health symptoms, this is a serious situation that requires immediate and professional attention. Do not attempt to remove significant black mold yourself, as improper handling can aerosolize the spores and worsen the contamination.

Your first step is to formally notify your landlord or building management in writing about the issue, including photos. They should arrange for a professional inspection to determine the exact moisture source. We strongly recommend a certified mold assessment to identify the species and the full extent of the problem, as what's visible is often just the tip of the iceberg. This report will be crucial evidence for determining liability.
