Is landlord responsible for mold removal in my apartment?« Back to Previous Page

My kids have been coughing and I suspect it's from this black, fuzzy patch that's been growing on the back wall of our master bedroom closet in our Jumeirah Village apartment. It started as a small spot after that really humid spell a couple of months ago, but it's definitely getting bigger. My landlord says it's from us running the AC too high, but that doesn't make sense to me. Who is actually responsible for getting this tested and removed, the tenant or the landlord?

Based on the UAE Civil Code and standard tenancy contract provisions, the responsibility for mold remediation in a rental apartment typically falls on the landlord. The landlord is legally obligated to provide a habitable property, which includes maintaining the structural integrity of the building and addressing issues arising from pre-existing defects, faulty construction, or inadequate waterproofing. Your landlord's assertion that running the AC "too high" causes mold is incorrect; in fact, it is the opposite. In Dubai's climate, the primary cause of the black, fuzzy mold you describe (Stachybotrys chartarum is a common suspect) is excessive humidity and condensation, often due to an underperforming or poorly maintained AC system that fails to properly dehumidify the air, or due to hidden leaks in the building envelope.

The persistent cough in your children is a significant health red flag commonly associated with exposure to mold spores. This situation requires immediate professional attention. You should formally notify your landlord in writing of the issue and request a professional mold inspection. Do not attempt to remove it yourself, as improper handling can aerosolize the spores and exacerbate the health risks and contamination.

For a definitive assessment and to establish responsibility, I strongly recommend a certified inspection. Our team at Saniservice can conduct a comprehensive assessment, including moisture mapping and air quality testing, to identify the exact moisture source and type of mold. This professional report will be crucial in determining liability and the required scope of remediation.
