Is landlord responsible for mold testing and removal?« Back to Previous Page

My kids have been coughing and I suspect it's from this black fuzzy stuff that’s growing behind the wardrobe in our master bedroom. We've lived here for 2 years and just noticed it, probably because we finally moved the furniture. The wall feels damp and it’s spreading. Who is responsible for getting this tested and fixed – me as the tenant or my landlord?

The responsibility for mold remediation in a rental property is typically determined by the source of the moisture. In the UAE, landlords are generally responsible for fixing structural or maintenance-related issues that cause dampness, such as leaking pipes, faulty AC drain lines, or cracks in the building envelope that allow water ingress. As a tenant, you are usually responsible for issues stemming from your own activities, like inadequate ventilation leading to condensation.

Given your description of a damp wall behind furniture, this strongly points to a condensation issue exacerbated by Dubai's high humidity and year-round AC use. Placing large furniture against an exterior wall can trap cool, moist air, creating a perfect environment for mold. However, the underlying cause could also be a hidden leak or insufficient insulation, which would fall under the landlord's purview.

Your first step is to formally notify your landlord or property management company in writing, with photos of the mold and damp wall. They are obligated to investigate the source of the moisture. For a case with visible spreading and health symptoms, a professional inspection is highly recommended to identify the exact mold species and moisture source. This diagnostic report is crucial evidence for determining responsibility. The landlord should address the root cause (e.g., repair a leak), while the cost of cleaning your personal belongings may be yours.

If the landlord refuses to acknowledge or fix a structural issue, you can escalate the matter to the Dubai Land Department or the relevant rental dispute committee in your emirate, as a landlord is required to provide a habitable property. Given the potential health impact on your kids, do not attempt to clean extensive growth yourself, as improper disturbance can release a high concentration of spores.
