Is landlord responsible for recurring black mold removal?« Back to Previous Page

My kids have been coughing and I suspect it's from black mold growing around the edges of our master bedroom closet in our Jumeirah Village Circle apartment. It's been spreading since the humidity really kicked in a few weeks ago. I've wiped it down with vinegar, but it just comes back worse. Am I responsible for paying for professional mold removal, or is this something my landlord has to fix since it's a recurring issue?

Based on the symptoms you've described and the recurring nature of the mold, a professional inspection is strongly advised. The persistent coughing in children is a significant health indicator that should not be overlooked, as certain species of black mold (like Stachybotrys chartarum) can produce mycotoxins.

In the UAE, the responsibility for mold remediation is typically determined by the root cause, as outlined in Dubai Law No. 26 of 2007, which regulates the relationship between landlords and tenants. If the mold is a direct result of a structural or maintenance issue—such as a leaking pipe in the wall, faulty waterproofing, or inadequate ventilation provided by the building's design—the financial responsibility falls squarely on the landlord to rectify the underlying defect and the resulting mold. However, if the mold is solely due to tenant behavior, like excessively drying clothes indoors without ventilation, the tenant may be liable.

Given the location (around the closet edges) and its correlation with high humidity, the cause is likely insufficient ventilation or possible thermal bridging in the wall causing condensation, which are structural or HVAC system issues. The fact that you've attempted remediation and it returns worse confirms the presence of a persistent moisture source that DIY methods cannot address. Vinegar is ineffective against many mold types and does not address the hidden moisture reservoir.

Your first step is to formally notify your landlord or property management company in writing, detailing the issue and your health concerns. We strongly recommend engaging a professional company like Saniservice to conduct a comprehensive inspection. Our certified inspectors will use moisture meters, thermal imaging cameras, and air quality tests to identify the exact moisture source and mold species, providing a definitive report that clarifies responsibility and outlines the necessary remediation protocol.
