Is landlord responsible for shower mold in JVC apartment?« Back to Previous Page

We’ve lived in our Jumeirah Village Circle apartment for two years and just noticed a bunch of black mold spreading in the corner where the shower meets the ceiling. The AC vent is right there and it always feels damp. My landlord is saying it's our fault for not ventilating properly, but I run the exhaust fan every time. Are we responsible for cleaning this, or is this something the building owner needs to fix?

Based on the specific conditions you've described in your JVC apartment, this is a complex issue that often involves shared responsibility, but the landlord likely holds a significant portion of the liability.

The primary concern is the location of the AC supply vent. If it is blowing cold air directly onto the shower ceiling corner, it is creating a massive condensation problem. The cold surface of the wall and ceiling, combined with the humid shower air, creates an ideal environment for mold growth that no amount of exhaust fan use can fully mitigate. This is a classic issue in Dubai's climate due to the extreme contrast between humid air and cold AC surfaces.

Under typical Dubai rental law (Law No. 26 of 2007), landlords are responsible for maintaining the structural integrity of the property and its core systems, which includes the installation and proper functioning of the AC system and its ductwork. A poorly placed vent that directly causes a habitability issue like mold falls under their obligation. Your documented use of the exhaust fan strengthens your position.

However, you must formally notify the landlord in writing of the issue, as continuous neglect on your part to report it could shift liability. We strongly recommend a professional inspection to determine the exact cause and extent. Surface cleaning is insufficient if the mold has penetrated the gypsum board, which is common in these scenarios. Our certified inspectors can conduct moisture mapping and air quality tests to provide a definitive report on the source, which is essential for resolving disputes with landlords.
