Is landlord responsible for shower mold remediation costs?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for about a year, and I've just pulled back the silicone sealant around our shower to find a ton of black mold growing underneath it. The musty smell has been getting worse for a couple of months, but I thought it was just the humidity. Is this something I need to fix myself, or is my landlord responsible for the remediation costs since it's a pre-existing issue with the seal?

In the UAE, particularly in humid climates like Dubai, the discovery of mold behind silicone sealant in a bathroom is unfortunately common due to year-round AC use and high ambient humidity, which leads to significant condensation. The responsibility for remediation costs under your tenancy contract is typically determined by the source of the moisture.

If the mold growth is a direct result of a maintenance failure—such as a leaking pipe within the wall, faulty grouting, or inadequate waterproofing that was present prior to your tenancy—then the landlord is generally responsible for the structural repair and associated mold remediation. The Dubai Rental Law (Law No. 26 of 2007) stipulates that landlords must maintain the property to ensure it is habitable.

However, if the moisture issue is attributed to tenant behavior, such as insufficient ventilation during and after showers, the responsibility may fall on you. The act of pulling back the sealant has now compromised the moisture barrier, which will require professional remediation to prevent further spread and potential health issues.

Given the extent you've described ("a ton of black mold") and the persistent musty smell, we strongly recommend a professional inspection. Our certified inspectors can conduct a comprehensive assessment to identify the exact moisture source and species of mold, which is critical for determining liability and the correct remediation protocol. DIY attempts often disturb the mold, causing spores to aerosolize and spread throughout your apartment.
