Is leaking AC causing mold my landlord's responsibility?« Back to Previous Page

The AC in my apartment seems to be leaking a little water onto the wall behind the unit in our master bedroom. We've lived here for 2 years and just noticed a patch of black mold spreading there, and the room has started to smell damp. Our contract in JVC is up for renewal soon, so is this something I should get my landlord to fix, or is it my responsibility as the tenant?

Based on UAE rental law, specifically Law No. (26) of 2007, landlords are responsible for maintaining the structural integrity of the property and its core systems, including the central air conditioning unit and its associated ducting and drainage. A leaking AC is a maintenance issue that falls squarely under the landlord's obligation, as it is a fixture of the property.
The situation you describe—a water leak leading to visible black mold and a damp odor—is a serious environmental health concern. The constant humidity in Dubai creates a perfect environment for mold proliferation once a moisture source is present. The black discoloration strongly suggests Stachybotrys chartarum or Aspergillus niger, both of which can pose significant health risks and require professional remediation. Simply wiping it away is insufficient, as the fungal roots (hyphae) penetrate deep into the building materials. Before your contract renewal, you must formally notify your landlord or property management company in writing about the issue, as this constitutes a defect affecting the habitability of the unit. They are obligated to engage a professional to address both the source of the leak (AC repair) and the resulting biological contamination (mold remediation). For a situation of this severity, we strongly recommend a professional indoor environmental inspection. Our certified team at Saniservice can conduct a comprehensive assessment, including moisture mapping and air quality testing, to determine the full extent of the contamination and provide a detailed remediation protocol for the landlord to action. Do not delay, as the problem will only worsen. For immediate assistance, please call us at 800-MOLDS (800-66537) or email hello@saniservice.com. |
