Is mold remediation a tenant or landlord responsibility?« Back to Previous Page

Our family has been in our Jumeirah villa rental for about three years, but over the past few months, we’ve noticed a persistent black mold growing along the bottom of the wall in our youngest son’s bedroom, which seems worse since the humidity really set in. He’s started having allergy-like symptoms, and we’re worried it’s connected. As tenants, are we responsible for the cost of the mold inspection and remediation, or is that the landlord's obligation to fix?

In the UAE, the responsibility for mold remediation in a rental property is primarily governed by the rental contract and the overarching principles of the Civil Code (Law No. 5 of 1985). The landlord is generally obligated to provide a habitable property that is free from structural defects that affect its intended use. Persistent black mold, often resulting from inherent building issues like leaking pipes, faulty waterproofing, or inadequate ventilation—common problems exacerbated by Dubai's high humidity and year-round AC use leading to condensation—is considered a structural defect. Therefore, the financial responsibility for both the professional inspection to diagnose the root cause and the subsequent remediation typically falls on the landlord.

As a tenant, your responsibility is to report the issue in writing to the landlord or property management company immediately upon discovery. You are also expected to maintain the property reasonably, such as using exhaust fans and ensuring AC units are serviced to reduce moisture buildup. However, the mold growth you describe along the wall base is a significant indicator of a moisture intrusion problem beyond normal occupant control.

Given that your son is exhibiting health symptoms, this is a serious matter that requires immediate professional attention. DIY cleaning is insufficient and can aggravate spore dispersal. A certified mold inspection is crucial to identify the moisture source, assess the contamination level, and prescribe a proper remediation protocol. We strongly recommend you contact our specialists at Saniservice for a comprehensive assessment. We can provide a detailed report to present to your landlord, clearly outlining the cause and necessary corrective actions.
