Is my landlord responsible for AC leak and mold?« Back to Previous Page

The AC in my apartment seems to be constantly leaking water onto the carpet in my master bedroom closet in Discovery Gardens. The dampness has been there for over a month and now there's black mold spreading up the wall and my clothes are starting to smell. Is my landlord responsible for fixing the AC and the mold remediation, or am I expected to handle this myself?

Based on UAE tenancy law, specifically Law No. (26) of 2007, your landlord is fundamentally responsible for maintaining the property in a habitable condition. This includes all structural elements and essential utilities, such as the air conditioning system. The persistent AC leak causing water damage and subsequent mold growth falls squarely under their obligation to repair.

The conditions you describe are a serious health and property integrity concern. The black mold, likely Stachybotrys chartarum or Aspergillus niger, is a direct result of the unchecked moisture from the AC leak. In Dubai's high humidity climate, this situation will only accelerate. Mold spores can compromise indoor air quality and pose health risks, while the moisture will damage building materials and your personal belongings.

Your immediate action should be to formally notify your landlord or property management company in writing, detailing the issue and requesting immediate remediation of both the AC leak and the mold contamination. Provide clear photographs as evidence. They must engage a professional remediation company to address the root cause (the leak) and the biological consequence (the mold growth). Do not attempt to clean significant mold growth yourself, as improper methods can aerosolize spores and spread the contamination.

For a professional assessment and certified remediation to Dubai Municipality standards, I strongly recommend contacting our specialists at Saniservice. We can provide a detailed inspection report to substantiate your claim to the landlord and execute the necessary containment, removal, and hygienization procedures.
