Is my landlord responsible for black mold in Dubai?« Back to Previous Page

My kids have been coughing at night and I’ve just found what looks like black mold behind the wardrobe in our master bedroom in Al Barsha. We've been in this apartment for about a year and it's our first summer here. I’m worried about their health, but I’m not sure if this is something I should handle myself or if it’s my landlord's responsibility to pay for a professional mold inspection.

Based on Dubai's rental law, specifically Law No. 26 of 2007, landlords are legally obligated to provide a habitable and well-maintained property. This includes addressing structural and maintenance issues that lead to health hazards, such as persistent mold growth. If the mold in your Al Barsha apartment is a direct result of a structural defect, such as a leaking pipe within the building's walls, a faulty air conditioning drain pan, or water seepage from the building envelope, the responsibility for investigation and remediation falls squarely on the landlord.

However, the unique climate of Dubai, characterized by extreme humidity and year-round AC use, can also create condensation issues if ventilation is inadequate. In such cases, liability can become a grey area. The presence of mold behind a large piece of furniture like a wardrobe is a significant indicator of a persistent moisture problem that likely requires professional diagnosis.

Given the health symptoms you've described, a professional inspection is strongly advised. A certified mold inspector can conduct air and surface sampling to identify the spore types and concentrations, trace the precise moisture source (whether structural or condensation-related), and provide a definitive report. This report is crucial evidence if you need to formally request remediation from your landlord.
