Is my landlord responsible for fixing black mold?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold I've found growing along the base of the wall in our Sharjah bedroom. It’s been spreading since the humidity really kicked in a few weeks ago, and the wall actually feels damp to the touch. Is the landlord responsible for the remediation and fixing the underlying moisture issue, or is this something I have to handle myself as the tenant?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for all major maintenance and repairs to the property's structure, including issues that affect its habitability and safety. The presence of widespread black mold, especially stemming from a structural moisture issue like a leaking pipe, faulty waterproofing, or a building envelope defect, falls squarely under this obligation. The landlord is required to address the root cause of the moisture to prevent recurrence.

However, the tenant is responsible for maintenance resulting from their own negligence or daily use, such as failing to use ventilation systems properly. Given the climate in Sharjah and across the UAE, where high humidity and continuous AC operation can lead to significant condensation if not managed, the specific cause of the dampness must be professionally determined.

Your description of the wall feeling damp and the mold spreading rapidly indicates a serious underlying moisture problem, not just surface condensation. This requires immediate attention. We strongly recommend you formally notify your landlord in writing of the issue and request a professional inspection and remediation. Do not attempt to clean significant black mold growth yourself, as improper disturbance can aerosolize toxic spores and exacerbate health risks, particularly for children with respiratory symptoms like coughing.

For a definitive assessment of the moisture source, identification of the mold species, and a legally compliant remediation protocol, you should engage a certified specialist.
