Is my landlord responsible for window mold in Jumeirah?« Back to Previous Page

My kids have been coughing for a couple of weeks and I just pulled back the curtains in our bedroom to find a huge patch of black mold spreading from the corner of the window frame down the wall. We keep the AC on most of the time to fight the humidity, but it seems like the seal around the window has failed. Who is responsible for getting this tested and fixed, me or my landlord in Jumeirah?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for the maintenance of the structural parts of the property, which includes the external walls and window frames. Since the issue you've described—a failed window seal leading to moisture intrusion and subsequent mold growth—is a structural defect, the responsibility for the repair of the window and the remediation of the resulting mold falls on your landlord.

The persistent cough your children are experiencing is a significant health concern commonly associated with exposure to mold spores, particularly the types of black mold (like Stachybotrys chartarum) that thrive in the conditions you described. Dubai's high humidity, combined with constant AC use, creates a perfect environment for mold if a moisture breach like a faulty seal occurs. The AC, while fighting ambient humidity, cannot counteract a direct water ingress point.

You must formally notify your landlord in writing of the issue immediately. It is strongly advised that you do not attempt to clean this yourself, as improper disturbance can aerosolize toxic spores and exacerbate the health risks and contamination. This situation requires professional assessment and remediation.

We recommend you contact a certified mold inspection company like Saniservice. Our experts can conduct a comprehensive inspection, including air quality and surface sampling, to identify the exact species and extent of contamination. This provides a legally sound report for your landlord and a clear remediation protocol.
