Landlord or tenant responsible for apartment mold and smell?« Back to Previous Page

Our master bedroom in this Jumeirah Village apartment has a persistent damp smell, and I’ve just found patches of black, fuzzy mold spreading behind the wardrobe. We’ve been running the AC constantly to fight the humidity, but it seems to be getting worse. Who is responsible for dealing with this, me as the tenant or my landlord, especially for the inspection and repair costs?

In the UAE, particularly in high-humidity climates like Dubai, the responsibility for mold remediation in a rental property is typically governed by the tenancy contract and Law No. 26 of 2007, also known as the Dubai Rental Law. The landlord is generally responsible for maintaining the structural integrity of the property and addressing issues arising from inherent building defects, such as faulty waterproofing, leaking central AC systems, or inadequate insulation that leads to condensation. The tenant is usually responsible for issues stemming from their own negligence, like failing to use the AC properly to control humidity or causing specific water damage.

The black, fuzzy mold you describe behind the wardrobe is a serious concern, often indicative of Stachybotrys chartarum or other toxigenic species. This suggests a persistent moisture source, likely condensation from the constant AC operation against a cold external wall or a hidden leak. Due to the health risks associated with airborne spores, a professional inspection is non-negotiable to identify the exact moisture source and mold species.

Your first step is to formally notify your landlord or property management company in writing, detailing the issue and including photographs. They are typically obligated to address the root cause. For the actual inspection and safe remediation, we strongly recommend engaging a certified specialist. DIY attempts can exacerbate spore dispersal. Our team at Saniservice uses advanced tools like thermal imaging and borescopes to pinpoint moisture intrusion and conducts air and surface sampling to determine contamination levels. We then execute a controlled remediation process following IICRC standards.
