Landlord or tenant responsible for bathroom mold in JVC?« Back to Previous Page

My bathroom’s ceiling in my Jumeirah Village Circle apartment has had these black mold spots growing in the corner for a couple of months now, and it’s getting worse after every shower. I’ve been running the exhaust fan, but the humidity just doesn't go away. Since I'm a tenant, am I responsible for fixing this, or is it my landlord's job to handle the remediation?

As a certified mold remediation specialist operating in Dubai, this is a common scenario we encounter, especially in high-humidity areas like Jumeirah Village Circle. The core issue you're describing—persistent humidity despite running an exhaust fan—points to a likely ventilation problem, potentially exacerbated by the building's AC system not managing condensation effectively, which is a frequent challenge in our climate.

Under UAE tenancy law, specifically Law No. (26) of 2007, the responsibility for maintenance of the property's core structure and fixed installations typically falls on the landlord. This includes addressing issues like faulty ventilation systems, leaking AC condensation lines within the walls, or inadequate waterproofing that lead to chronic dampness and mold growth. As a tenant, you are generally responsible for maintenance due to daily use and for reporting the issue in a timely manner.

However, the persistent nature of the problem, indicated by its continued worsening, suggests an underlying defect beyond surface moisture. The black spots are likely Stachybotrys or Aspergillus, which can pose health risks with prolonged exposure.

My professional recommendation is to immediately request a professional inspection from your landlord. Do not attempt to bleach it, as this will only temporarily remove the color and not the root cause or the hyphae (root structure) within the ceiling material. A certified inspector, like our team at Saniservice, will conduct humidity mapping and air quality tests to identify the moisture source definitively and determine liability. This evidence is crucial for discussions with your landlord.

For a definitive assessment and a legally compliant remediation plan, I strongly advise you to contact our specialists. Call 800-MOLDS (800-66537) or email hello@saniservice.com to schedule an inspection.
