Landlord or tenant responsible for mold in wardrobe?« Back to Previous Page

The back wall of my wardrobe, which is on the same side as the building's exterior, has started showing these black speckles. It's been getting worse since the humidity spiked a couple of weeks ago, and now all my clothes smell damp. Who is supposed to handle and pay for this kind of mold removal – me as the tenant, or is this the landlord's responsibility to fix?

Based on the UAE Civil Code, specifically Federal Law No. 5 of 1985, the responsibility for structural repairs and issues related to the building's envelope fall upon the landlord. The black speckles on the exterior-facing wall of your wardrobe strongly indicate a potential breach in the building's waterproofing or an insulation failure, leading to moisture intrusion from the outside. This is a structural defect, not a result of tenant activities like inadequate ventilation.

However, the persistent high humidity common in Dubai, especially when combined with year-round air conditioning which can cause significant condensation on cold surfaces, can exacerbate the issue. While the landlord is responsible for fixing the root cause (the leak or insulation defect), the tenant is typically responsible for maintaining adequate ventilation to manage ambient moisture levels.

Your first step is to formally notify your landlord or property management company in writing, with photographs, about the suspected moisture intrusion. They are obligated to investigate and rectify the structural defect. Do not attempt to clean it yourself, as improper handling can aerosolize toxic spores.

For a definitive assessment of the cause, extent, and required remediation protocol, a professional inspection is crucial. We at Saniservice use thermal imaging cameras and moisture meters to pinpoint the exact source of moisture and provide a detailed report that can be used to formally establish responsibility with your landlord.
