Landlord or tenant responsible for mold inspection?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a patch of black mold spreading from the corner of our bedroom ceiling after this winter's heavy fog. Our 4-year-old has been coughing more than usual, and I'm starting to worry. Are we responsible for getting and paying for a professional mold inspection, or is this something our landlord has to handle?

In the UAE, the responsibility for mold inspection and remediation is primarily governed by the rental contract and Law No. 26 of 2007, known as the Dubai Rental Law. Generally, the landlord is responsible for maintaining the structural integrity of the property, which includes addressing issues like water leaks from external walls or faulty AC systems that lead to condensation and mold growth, a common issue in Dubai's humid climate exacerbated by year-round AC use.

As a tenant, you are responsible for maintaining cleanliness and proper ventilation to prevent moisture buildup. However, the mold you describe originating from the ceiling corner is highly suggestive of an underlying leak or significant condensation issue within the building envelope, which typically falls under the landlord's purview. Given that you have a young child exhibiting respiratory symptoms, this situation should be treated as a serious health and safety concern.

I strongly recommend you formally notify your landlord or property management company in writing immediately, detailing the issue and including photographs. Request a professional mold inspection to identify the exact species and the moisture source. Do not attempt to clean it yourself, as improper disturbance can aerosolize toxins.

For a definitive assessment, I advise engaging a certified professional environmental company like Saniservice. Our experts use thermal imaging, moisture meters, and air quality testing to pinpoint the source and extent of contamination, providing a legally sound report for your landlord.
