Landlord responsible for mold from damp wall in rental?« Back to Previous Page

The wall behind our wardrobe in the master bedroom of our Jumeirah Village Circle apartment has started to feel damp, and there's a small patch of black mold spreading. We noticed it about a month ago, but it's definitely gotten worse since the last heavy dew. We're coming up on the end of our two-year tenancy, and I'm worried the landlord will try to blame us and deduct from our security deposit. Are we responsible for getting this treated, or is fixing the root cause of the dampness the property owner's obligation?

Based on UAE rental law, specifically Article 17 of Law No. 26 of 2007, the landlord is fundamentally responsible for maintaining the property's structural integrity and ensuring it is habitable. This includes addressing issues like water infiltration, rising damp, or leaks that originate from the building's structure itself, which are the typical root causes of persistent dampness and subsequent mold growth.

The key factor here is the source of the moisture. If the dampness is due to a structural defect, such as a leaking pipe within the wall, a crack in the external facade, or faulty waterproofing—common issues exacerbated by the UAE's high humidity and heavy dew—then the financial and remedial obligation falls squarely on the landlord. You, as the tenant, are typically only responsible for damage resulting from your own negligence or misuse.

Given that the mold is spreading behind a fixed wardrobe in the master bedroom, this strongly suggests a hidden structural or plumbing issue. To protect your security deposit, we strongly advise you to formally notify your landlord or property management company in writing immediately, detailing the problem and requesting a professional inspection to identify the moisture source. Do not attempt to remove the mold yourself, as improper handling can spread spores and exacerbate the problem.

For a definitive assessment and a detailed report that can be used to establish liability, you need a certified mold inspection. Our experts can identify the exact moisture source and type of mold, providing a professional documentation that is crucial for discussions with your landlord.
