Mold in AC: landlord or tenant responsibility in Dubai?« Back to Previous Page

The AC in my apartment seems to be blowing a damp, musty smell into our living room in Jumeirah. I finally pulled the filter out and the wall behind it is covered in black and green mold. My landlord is saying it's our fault for not cleaning the filter regularly, but we only moved in six months ago. Who is legally responsible for getting this cleaned and repaired, us or the landlord?

Based on UAE Civil Code and the standard Ejari rental contract, the responsibility for maintenance of major fixtures, including the central air conditioning system and its internal ductwork, falls upon the landlord. This is considered a fundamental part of the property's habitability, especially given Dubai's climate where year-round AC use is mandatory.

The mold growth behind the filter indicates a more serious issue than a dirty filter; it points to excess moisture within the AC unit or evaporator coil, often caused by a drainage blockage, low refrigerant, or a faulty seal. This is a mechanical failure, not a result of simple tenant maintenance. While tenants are typically responsible for routine filter cleaning (every 3-4 months), the systemic mold contamination you describe is the landlord's legal responsibility to remediate.

We strongly recommend you do not attempt to clean this yourself. Disturbing the mold can aerosolize spores throughout your apartment. This requires a professional mold inspection and remediation service to properly assess the extent of contamination within the ductwork and safely remove it.

For a definitive assessment and to ensure your landlord addresses the root cause, we advise you to contact a professional. Saniservice can provide a comprehensive inspection and a detailed report, which can be used to formally request repairs from your landlord.
