Should landlord handle mold issues?« Back to Previous Page

After the heavy rains last month, I noticed a strange musty smell coming from under the sink in the bathroom. The AC in my apartment seems to struggle more than usual too. We’ve lived here for 2 years and just noticed some water pooling around the base of the wall in the same area. Is it typical for mold chillers to be installed by tenants or is this something the landlord should handle?

Based on UAE's real estate and property management regulations, it is the landlord’s responsibility to maintain the premises in good condition. This includes addressing moisture-related issues that can lead to mold growth, which your observations might suggest are present. According to the Property Management Law (Federal Decree-Law No. 18 of 1995), landlords must ensure the property remains in a state fit for habitation and address any defects or damages promptly.

However, it's important to note that tenants have a duty to maintain the property in accordance with the lease agreement and avoid actions that might contribute to water damage or mold growth. In your situation, where you've noticed water pooling near the base of the wall and an unusual smell under the sink, these could be signs of underlying moisture issues that need immediate attention.

Given the conditions described, it would be wise for both parties to engage a professional environmental inspector who can conduct a thorough mold inspection. Such experts are familiar with local regulations and can provide accurate assessments and remediation plans tailored to Dubai's climate and building standards.

Here are some practical steps you could take:

1. Document the Issue: Take photos of the affected areas and note down when you first noticed these issues. This documentation will be crucial for any subsequent communication or legal actions.
2. Contact Your Landlord: Inform them about your observations politely but firmly, providing evidence from the photos you’ve taken. If they do not respond satisfactorily, consider escalating to their management company or even a tenant's association.
3. Engage a Professional Inspector: A reputable environmental inspection service like Saniservice (contact 800-MOLDS or email hello@saniservice.com) can assess the situation and provide expert guidance on remediation efforts.

Remember, addressing mold issues early is crucial to prevent health risks and structural damage. Mold growth in high humidity conditions such as those experienced after heavy rains can rapidly deteriorate materials like drywall and wood, leading to more extensive repairs down the line.

In summary, while it's ultimately the landlord’s responsibility to address these issues, engaging a professional for an inspection is recommended to ensure proper handling of the situation. Stay vigilant and document all interactions to protect your rights as a tenant in Dubai.
