Who fixes and pays for hidden leak and mold?« Back to Previous Page

The wall behind the wardrobe in our master bedroom in Jumeirah Village Circle has patches of black mold. I think it might be from a hidden leak because the paint is also bubbling. We've been wiping it off, but it just comes back stronger every few days. Who is responsible for getting this properly fixed and paying for it, me as the tenant or the landlord?

In Dubai, the responsibility for repairs and payment typically falls on the landlord for issues related to the property's structure and hidden infrastructure, like a leaking pipe inside the wall. Since you describe a recurring problem with paint bubbling, this strongly indicates a persistent moisture source that is the landlord's responsibility to address under standard tenancy contracts.

Your first step is to formally notify the landlord or property management company in writing, detailing the issue and including clear photographs of the mold and water damage. The bubbling paint is a critical visual indicator of the leak's severity. Under Dubai's rental laws, the landlord is generally obligated to maintain the property in a habitable condition, which includes fixing leaks that cause mold.

Simply wiping the mold is a temporary measure; the hidden leak must be found and repaired to prevent regrowth. The high humidity in Dubai, especially when combined with a constant water source from a leak, creates an ideal environment for rapid mold recurrence.

For a documented case like this, a professional inspection is highly recommended to pinpoint the exact source of the moisture. This provides concrete evidence for the landlord and ensures the correct remediation steps are taken. The inspection cost may be your responsibility initially, but if a significant structural leak is confirmed, you can often negotiate for reimbursement. The subsequent repair of the leak and the mold remediation should be covered by the landlord.
