Who fixes mold from AC leak: landlord or tenant?« Back to Previous Page

The AC in my bedroom has been leaking a bit for a couple of months, and now I’m finding black spots of mold on the wall behind the curtain and on the ceiling. My two-year-old has had a runny nose and a cough that just won’t go away, and I’m starting to get worried it’s connected. As a tenant in Dubai Marina, who is legally responsible for fixing the AC unit that caused this and for the mold remediation – me or my landlord?

Under Dubai law, the landlord is typically responsible for maintaining and repairing the AC unit itself, as it is considered a fixture of the property. This includes fixing leaks that originate from the unit. The resulting mold damage to walls and ceilings also generally falls under the landlord's responsibility for structural repairs.

However, you must formally notify them in writing about the leak and mold to start the clock. For a persistent issue like this, a professional inspection is critical to document the source and extent of the problem. The high humidity here, combined with condensation from a leaking AC, creates a perfect environment for mold, which can spread behind walls.

Regarding your child's health, that is a legitimate concern. Airborne spores from wall and ceiling mold are a common irritant, especially for young children, often causing persistent respiratory symptoms like you've described. A proper remediation process should include containment, removal of affected materials, and verification that the space is safe—something a certified professional should handle.

Start by sending a dated written notice to your landlord or property management company, detailing the AC leak and visible mold, and request immediate repairs and remediation. Include clear photos. If they are unresponsive, you can escalate the matter to the Dubai Land Department or the Rental Dispute Center. Your tenancy contract may also have specific clauses, but the law generally favors the tenant in cases of landlord negligence over essential maintenance.
