Who is responsible for AC leak and black mold?« Back to Previous Page

The AC in my apartment seems to be leaking a bit of water onto the wall in our second bedroom, and now we’re seeing a bunch of black, fuzzy spots spreading behind the wardrobe. We’ve lived here for 2 years in Jumeirah Village Circle and just noticed it while cleaning. Who is responsible for dealing with this and the repair – us as tenants or the landlord?

Based on the UAE Civil Code, specifically Federal Law No. 5 of 1985, the responsibility for structural repairs and maintenance of the property, including the fixed air conditioning system, falls upon the landlord. An AC unit leaking water is a maintenance issue that the property owner is obligated to address. The resulting black mold growth is a direct consequence of that moisture intrusion.

In the humid climate of Dubai, where AC systems run year-round, condensation leaks are a primary cause of indoor mold. The black, fuzzy growth you describe behind the wardrobe is a significant indicator of a sustained moisture problem. This type of mold, often Stachybotrys chartarum or other toxigenic species, can pose health risks and degrade building materials.

Your first step is to formally notify your landlord or property management company in writing about the AC leak and the subsequent mold growth, as this affects the habitability of the property. They are responsible for arranging the repair of the AC drain line or unit and for the remediation of the resulting damage.

However, due to the potential health implications and the technical nature of proper mold remediation, we strongly recommend a professional inspection. DIY attempts often disturb the spores, spreading contamination. Our certified experts at Saniservice can conduct a comprehensive assessment to determine the extent of the mold colonization, identify the species, and provide a detailed protocol for safe, effective remediation that we can present to your landlord.
